IN THE 11TH JUDICIAL DISTRICT OF NEBRASKA
GENERAL ORDER 8-1 CONCERNING COMPLIANCE WITH PARENTING ACT
No contested case which involves the custody of, or parenting time or visitation with, any minor child or children may be set for final hearing by any attorney or self-represented party unless the following documents have been filed with the Clerk of the District Court.
1) Attorney Certificates of Providing Parenting Act Information signed by each attorney who has entered an appearance in this case or, for self-represented individuals, a verified and sworn statement that each has received and read the Nebraska Parenting Act Information brochure;
2) Final Child Information Affidavits by each party;
3) Certificates of Completion of an approved Basic Legal Parenting Education Course signed by each party or a verified request for waiver of such requirement signed by both parties setting form good cause for such waiver;
4) Affidavits signed by a Parenting Act Mediator or Specialized ADR Facilitator that both parties have met for at least one session lasting two hours or more in a good faith attempt to settle the case.
All forms shall be the same as, or substantially similar to, those found on the Nebraska Judicial Branch website.
All mediators or facilitators must be approved by the Nebraska Office of Dispute Resolution.
In the event one party fails or refuses to comply with any part of this order, the opposing party may file a Motion to Compel or Motion for Sanctions which will be promptly scheduled for hearing by the court.
